These terms explain who we are, how we sell to you, what happens if something goes wrong, and what each of us is responsible for. They are written in plain English. Nothing in them takes away the rights you have by law.

1. Who we are and how to contact us

This website is operated by ToolPoint Solutions, an independent mobile tool sales business covering Barnsley, Rotherham, Sheffield, Wakefield and private events across Yorkshire.

When we say “we”, “us” or “our” in these terms, we mean ToolPoint Solutions. When we say “you”, we mean the person buying from us or using this website.

2. These terms

These are the terms on which we sell products to you. Please read them before you order — by placing an order you accept them. If you do not agree with them, please do not order.

Our Privacy Policy explains what we do with your personal information, and our Delivery & Returns page sets out current delivery areas, costs and timescales. Both form part of these terms.

3. Placing an order, and when a contract is made

When you place an order you are offering to buy from us. Our acceptance of that offer, and the point at which a contract comes into existence, is when we send you an email confirming that your order has been dispatched — not when you place the order, and not when you receive an automatic acknowledgement.

If we cannot accept your order we will tell you and will not charge you. This might be because the product is out of stock, because we have identified an error in the price or description, because we cannot meet a delivery deadline you have specified, or because we cannot deliver to your address.

We may refuse or cancel any order where we reasonably believe it has been placed fraudulently, or where a product is subject to an age restriction and we are not satisfied that you meet it.

4. Products, descriptions and images

We take care to describe our products accurately. Photographs and illustrations are for guidance: packaging, finish and minor details can change without notice, and colours shown on your screen may differ from the product itself.

Some products we hold in stock on the van. Others we order in for you once you have bought them. Where an item is ordered in, this is stated on the product page and in your order confirmation, together with the expected timescale. Timescales are estimates, not guarantees, and depend on our suppliers.

5. Prices and VAT

Prices are shown in pounds sterling and include VAT at the applicable rate unless we state otherwise. A small number of products are zero-rated for VAT and are priced accordingly.

Delivery charges are not included in the product price. They are shown separately before you pay, and depend on your address and what you have ordered.

We try hard to price everything correctly, but mistakes happen. If we discover an error in the price of something you have ordered, we will contact you before dispatch to ask whether you wish to continue at the correct price or cancel. If the pricing error is obvious, and you could reasonably have recognised it as a mistake, we may cancel the order and refund you in full.

Where we show a product as reduced, any previous price shown alongside it is a price at which we offered that product for sale beforehand.

6. Payment

You can pay by the methods shown at checkout. Card payments are handled by our payment provider — we never see or store your full card details.

Where you pay by bank transfer, your order is held until the payment reaches us, and we will dispatch once it has cleared. If payment has not reached us within [[ TO CONFIRM — e.g. 7 ]] days we may cancel the order and release the stock.

The products remain our property until we have received payment in full. Responsibility for them passes to you when they are delivered to the address you gave us, or when you collect them from us.

7. Delivery and collection

Current delivery areas, methods, costs and timescales are set out on our Delivery & Returns page and are shown to you at checkout before you pay.

We will deliver your order within 30 days of the contract being made unless we have agreed a different time with you. If we miss that, and delivery by a particular date was essential — either because you told us so when you ordered, or because it is obvious from the circumstances — you may treat the contract as at an end and we will refund you in full.

If nobody is available at your address to take delivery, the carrier will leave a note explaining how to rearrange or collect. If, after a reasonable period, delivery cannot be completed and you have not made contact, we may end the contract and charge you the reasonable costs of the failed delivery.

8. Your right to change your mind

If you are a consumer buying online, you have a legal right to change your mind under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You do not have to give a reason.

  • You have 14 days from the day you (or someone you nominate) receive the goods to tell us you are cancelling. Where an order is delivered in several consignments, the 14 days run from the day you receive the last one.
  • Tell us by email, phone or in writing. You can use the model cancellation form in the Regulations, but you do not have to.
  • You then have a further 14 days to send the goods back to us.
  • We will refund you within 14 days of receiving the goods back, or of you showing us proof that you have sent them, whichever is sooner.
  • We refund the price you paid plus the standard delivery cost. If you chose a more expensive delivery option than our standard one, we refund the standard cost only.

You pay the cost of returning the goods unless they are faulty or not as described. You may handle the goods as you would in a shop, but if you use or damage them beyond that, we may reduce your refund to reflect the loss in value.

This right does not apply to products made to your specification or clearly personalised, to sealed goods that are not suitable for return once unsealed for health or hygiene reasons where the seal has been broken, or to other categories the Regulations exclude.

9. Faulty goods and your legal rights

Your rights under the Consumer Rights Act 2015 sit alongside the right to change your mind above, and nothing here replaces them. Goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not:

  • within 30 days of receiving them, you can reject them and get a full refund;
  • up to six months, we will repair or replace them — and if that does not fix the problem, you can have a refund;
  • after six months, the same applies, but you may need to show that the fault was there when you received them.

Tell us as soon as you can, with your order number and a description or photograph of the problem. We will pay reasonable return postage on faulty goods. This does not cover fair wear and tear, misuse, accidental damage, or failure to follow the manufacturer’s instructions.

Where a product carries a manufacturer’s guarantee, that is in addition to your legal rights against us, not instead of them.

10. Business customers

If you are buying in the course of a business, the consumer rights in sections 8 and 9 do not apply to you. Instead: the goods will correspond with their description and be of satisfactory quality; we will deal with genuine faults reported promptly; and returns of correctly supplied goods are at our discretion. Nothing in this section affects any liability we cannot exclude by law.

11. Age-restricted products and safe use

Some of the products we sell are age restricted by law, including knives and other bladed articles. We do not sell these to anyone under 18. Where you order an age-restricted product, it must be delivered into the hands of someone aged 18 or over, and proof of age may be required at the door. If it cannot be handed over, the item will be returned to us.

Tools can cause serious injury if misused. You are responsible for using them safely, for wearing appropriate protective equipment, and for following the manufacturer’s instructions and any applicable safety regulations. Products are sold for their intended purpose only.

12. Your account

If you create an account, keep your password confidential and do not let anyone else use it. Tell us promptly if you think someone else has your details. We may suspend or close an account where we reasonably believe it is being misused.

13. Using this website

You may use this website for browsing and ordering. You must not attempt to gain unauthorised access to it, interfere with its operation, introduce malicious code, scrape it systematically, or use it in any way that is unlawful or that could damage its reputation.

We do our best to keep the site available, but we cannot promise it will be uninterrupted or free of errors, and we may suspend, withdraw or change any part of it.

14. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking them or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, and for breach of your statutory rights in relation to the goods.

If you are a business customer, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability in connection with any order is limited to the price paid for it.

15. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, supplier failure, carrier disruption or utility outages. If one occurs we will contact you as soon as we can and the delivery date will be extended. If the delay is substantial you may cancel and we will refund anything you have paid for goods not delivered.

16. Intellectual property

The content of this website — text, layout, graphics and our name and logo — belongs to us or our licensors and is protected by law. You may view and print pages for your own use, but you may not reproduce or republish any part of it commercially without our permission. Manufacturer brand names, product images and trade marks remain the property of their owners.

17. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published on this page when you placed it. The date at the top shows when we last changed anything.

18. Complaints

If something has gone wrong, please tell us first — email toolpointsolutions@gmail.com or call 07876 653396 and we will do our best to put it right. We aim to acknowledge complaints within 7 working days and to resolve them within 14 working days.

19. Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts there.
